New Email Tracking Regulations: Bring Your Campaigns into Compliance

To support our users subject to these regulations in achieving GDPR compliance, we have updated our platform.

The CNIL (French Data Protection Authority) has issued strict guidelines regarding the use of tracking pixels and tracked links in emails. These directives serve as a reminder that behavioral tracking (measuring open rates, clicks, etc.) can no longer be carried out by default and requires the user's explicit prior consent.

What’s Changing on Our Platform

A new setting in your Emailing configuration now allows you to condition engagement statistics on the participant's explicit consent.

  • Engagement statistics (conditioned on consent): Open rates, clicks per link, device breakdown.

  • Deliverability statistics (always active): Sent status, delivered, bounce, and spam reports. These technical elements remain active in all cases to ensure proper message delivery.

✍️ This setting is disabled by default. There is no immediate impact on your existing campaigns or for clients operating outside the scope of the CNIL. We recommend enabling it for any campaign published after August 1st!

The 2 Key Steps to Set Up Consent for Your Campaigns

To collect consent from your participants and continue analyzing your email performance in compliance with the GDPR, follow these two steps:

1. Add the checkbox to your collection form

Go to the Content section of your form. In the section dedicated to checkboxes (located directly below the Rules, Newsletter, Partners, and SMS options), add the new dedicated consent field: "Email tracking consent".

2. Enable the restriction in your email settings

In your email settings, check the box:

“Make email tracking contingent on subscribers' consent:”.

Point of attention upon publication: An alert will appear in the editor if you enable tracking restrictions in the email without having added the corresponding consent field to your form.

Tracking Results and Collecting Statistics

Once these two settings are correctly configured:

  • If the participant checks the box: The measurement tools are activated for this recipient. You will collect all your usual engagement data (email opens, link clicks, etc.).

  • If the participant does not check the box: The email will be delivered successfully, but no tracking pixel or link will be activated. Their interactions will not be counted in your engagement metrics.

You can view all consolidated reports and data directly from the Emailing tab in your Statistics section.

To meet GDPR traceability requirements, the exact timestamp of the agreement is recorded. The precise date and time of consent for email tracking are directly integrated into and accessible from your participant data exports.

📌 What if your business is based outside the European Union?

This compliance feature specifically targets European data protection regulations (notably the GDPR and directives on cookies/trackers).

If your company and your recipients are located outside the European Union, you are not required to enable this option unless you are subject to similar local legislation or target EU residents.
